Investing Restrictions And Investment Caps
The Foreign Direct Investment (FDI) limit in India is set by the government, and various limits have been set for different industries. Over a period of time, the government has gradually raised the limits on a variety of activities. FDI limits are typically in the range of 26 percent to 100 percent of a country’s GDP.
By default, the maximum limit for portfolio investment in a certain publicly traded company is determined by the foreign direct investment (FDI) limit specified for the sector to which the company belongs. Portfolio investing, on the other hand, is subject to two additional limitations. First and foremost, the aggregate restriction on investment by all foreign institutional investors (FIIs), including their sub-accounts, in any one company has been set at 24 percent of the paid-up capital. 8 However, with the agreement of the company’s boards of directors and shareholders, the limit may be increased up to the sector cap.
Second, no one foreign institutional investor (FII) should invest more than ten percent of the business’s paid-up capital in any one company at a time. There is a separate 10 percent investment limit for each of the sub-accounts of a FII in any one company, according to the regulations. However, in the event of foreign companies or individuals investing as a sub-account, the same limit is only applied to a maximum of 5 percent of the total amount of investment. Regulations also place restrictions on the amount of money that may be invested in equity-based derivatives that are traded on stock exchanges.
